By creating an account and engaging our services as a Client, you agree to be bound by these Terms and Conditions (“Terms”), together with any policies referenced within them. Please read them carefully, if you do not accept these Terms, you should not use our services.
We may update these Terms from time to time by posting a revised version on our website. We encourage you to check this page periodically. Throughout these Terms, our website, all services offered on it, and all associated content, text, graphics, interface design, layout, data, and the selection and arrangement of that content, are collectively referred to as the “Site” and/or the “Service.”
We reserve the right, at our sole discretion, to review, decline, or remove any project or user-submitted content that breaches these Terms or that we otherwise consider inappropriate — including content that is unlawful, obscene, defamatory, discriminatory, or that infringes the rights of others. Where activity appears to us to violate the law, we may report it to the relevant authorities.
You agree that we may access, retain, and share information in your account where required by law, or where we believe in good faith that doing so is necessary to: (a) comply with a legal obligation; (b) enforce these Terms; (c) respond to a claim that content violates a third party's rights; (d) respond to a support request you have raised; or (e) protect the safety, rights, or property of Jackson Hill Digital, our users, or the public.
We may amend these Terms at any time without prior notice. It is your responsibility to review them periodically, and we are not liable to you or any third party for changes made to these Terms.
2How Jackson Hill Digital Works
2.1 Overview
Jackson Hill Digital is an online service through which registered Clients submit project requirements and reference materials (“Creative Brief”), request adjustments to those requirements (“Revision Brief”), and receive completed work (“Response”) from designers and developers engaged by Jackson Hill Digital (“Team Members”). Service is delivered according to the package you select. Your final deliverable is produced through a cycle of briefs, revisions, and responses until it satisfies your requirements.
2.2 Submitting a Brief
You are responsible for providing a clear and complete description of each Creative Brief, including any relevant reference material and deadlines. Each Response you request will be governed by a corresponding scope document (“Term Sheet”). We are under no obligation to review any brief or Term Sheet for accuracy or completeness, and we may decline a brief at our discretion.
2.3 Reviewing a Response
Once we deliver a Response, you are responsible for reviewing it promptly. If you do not notify us that a Response does not meet the agreed brief, it will be treated as accepted. If you do raise concerns, you must submit a Revision Brief describing the changes needed, after which we will provide an updated Response. We are not responsible for the outcome of a Response to the extent it was produced in line with your own briefs.
2.4 Revision Cycles
A typical revision cycle includes two to six additional iterations based on your feedback. Earlier cycles allow for more substantial changes; by the third round, requests should be limited to refinements of the existing direction rather than a new concept altogether.
3Eligibility and Acceptable Use
3.1 Eligibility
To register as a Client you must be at least 18 years old, agree to these Terms and our Privacy Policy (available at jacksonhilldigital.com/privacy-policy), and complete registration. By registering you confirm that the information you provide is accurate, and, if registering on behalf of an organization, that you are authorized to bind that organization to these Terms. We may accept or decline any registration at our discretion.
3.2 Permitted Use
You may use the Service only as permitted under these Terms and any published policies. You may submit briefs and receive Responses only once registered as a Client. You may view the Site on your own devices and, under fair-use principles, print limited excerpts for personal reference.
3.3 Prohibited Conduct
You agree not to:
- Reproduce, redistribute, resell, or publicly broadcast content from the Site beyond what these Terms permit;
- Submit material that infringes copyright, trade secrets, or other proprietary rights you do not own;
- Post content that is unlawful, defamatory, harassing, hateful, sexually explicit, or otherwise objectionable;
- Use the Service to send unsolicited advertising, chain messages, or similar schemes;
- Upload malicious code intended to damage, intercept, or disrupt any system or data;
- Provide false or incomplete registration information;
- Alter or remove content belonging to other users;
- Place unreasonable load on our infrastructure or interfere with normal operation of the Service;
- Use bots, scrapers, or similar tools to access the Site outside of standard browser use; or
- Attempt to reverse-engineer, decompile, or extract the source code of any software underlying the Site.
3.4 Security
You must not attempt to compromise the security of the Site, including unauthorized access to accounts or systems, probing for vulnerabilities, disrupting service to other users, or falsifying header information in any communication sent through the Service. Violations may be referred to law enforcement. We may review, remove, or restrict access to any content or account at our discretion, and while we take reasonable steps to keep your communications confidential, we may disclose them where required by law or necessary to protect our rights.
3.5 Availability
We aim to keep the Site accessible but do not guarantee uninterrupted availability. We are not liable for delays, outages, or errors arising from technical issues, and we may modify, suspend, or discontinue any part of the Service at our discretion without liability for resulting loss.
4Refunds, Cancellations, and Payment
4.1 When Refunds Do Not Apply
No refund will be issued where any of the following apply:
- You selected a custom or special-scope package;
- The initial concept has already been approved;
- You have requested revisions to the work;
- The cancellation reason is unrelated to our performance;
- You have not been in contact with us for more than two weeks during an active project;
- Our policies have been breached;
- Another provider has been engaged for the same project;
- The original brief lacked sufficient detail to work from;
- A complete change of direction has been requested after work began;
- The refund request window has closed; or
- The underlying business is closing, rebranding, or changing ownership.
Reasons such as a change of mind or an internal disagreement between business partners are not eligible for a refund. Where a bundled service is purchased and only one component is unsatisfactory, any refund will apply to that component only, not the full bundle. No refunds will be issued more than seven days after purchase. Services such as social media management, SEO, domain registration, and hosting are non-refundable at any stage. For website projects, no refund is available once a design has been approved and moved into development.
Jackson Hill Digital reserves the right to decline or terminate any project at its discretion. Where a refund is issued, you forfeit any right to use the associated designs, which remain our exclusive property.
4.2 Cancellations
An order may be cancelled within seven days of purchase for eligible reasons only, this excludes a change of mind, a disagreement with a business partner, or finding a lower-priced alternative, since these do not relate to our service delivery. A cancellation within the first 24 hours will incur a charge of 15% of the invoice; after 24 hours, the charge rises to 25%, reflecting costs and resources already committed. Cancellation requests must be sent to support@jacksonhilldigital.com.
4.3 Communication and Delivery
- All correspondence between our team and you should take place through the email address registered on your account.
- For each delivery, we will attempt to reach you by email at least three times.
- If you do not respond after three attempts and seven consecutive working days have passed since delivery, the project will be considered accepted, and no refund will be issued after that point.
- If you remain unresponsive for ten consecutive days, any money-back guarantee associated with the project becomes void.
- Jackson Hill Digital reviews and applies these provisions at its own discretion.
4.4 Payment Processing
Card payments (Visa, Mastercard, Amex) are processed through our banking partners; we do not store your full card details on our own systems. Where recurring billing applies, card details are held securely by our payment processor. We also accept payment by bank transfer or company cheque. Payments made via PayPal are processed by PayPal directly. All prices shown on the Site exclude applicable taxes.
5Money-Back Guarantee, Details

A project with no activity for more than six months is considered closed, and any related guarantee period will have expired.
5.2 Frequently Asked Questions
How long does a refund take?
Approved refunds are typically processed within 21 business days.
Does the guarantee cover every package?
It applies to design packages only. Once a design has been approved and further revisions requested, the money-back guarantee ends, though our satisfaction guarantee, under which we continue refining the work, still applies.
Why offer a money-back guarantee at all?
We stand behind the quality of our work and offer this guarantee in good faith, expecting the same from our clients. Most clients engage constructively and provide the feedback needed to get their project right. A small minority attempt to misuse this policy, for example, ordering from multiple providers simultaneously with the intention of requesting refunds from all but one. We reserve the right to decline service to anyone engaging in that pattern.
Design work is inherently subjective, and meaningful client feedback is usually necessary to reach a final result, first drafts are rarely the finished product but are a starting point for that conversation. This guarantee exists to protect clients in cases where we do not deliver as promised, not to provide free design exploration.
5.3 Exclusions
The money-back guarantee does not apply to:
- Content writing services;
- SEO services;
- Marketing support services;
- Phone-based services; or
- Projects delivered for design agencies or studios working on behalf of their own clients.
Clients who receive a refund forfeit the right to use any concepts provided during the project; ownership of that work remains with us until payment is made in full.
6Ownership and Usage Rights
6.1 The Site and Service
Other than as expressly stated in these Terms, Jackson Hill Digital owns all rights, title, and interest, including copyright, trademark, and other intellectual property rights, in the Site and Service, to the fullest extent recognized under applicable law. You may not remove or alter any copyright notice or attribution on the Site, and you may not use our name, logo, or trademarks without our prior written consent.
6.2 Information You Submit
By submitting a brief, revision request, or any related material (“Client Information”), you grant us the rights needed to use that information for the purpose of delivering your Response and for our internal records. Team Members assigned to your project may access the relevant scope information to complete the work.
6.3 Our License to Use Submitted Content
You grant Jackson Hill Digital a royalty-free, worldwide, sublicensable license to use, reproduce, adapt, and display the Client Information you submit, for as long as necessary to deliver the Service and any related Response.
6.4 Your Rights in the Final Deliverable
Provided you have complied with these Terms, you will own the final approved deliverable (“Final Product”) once full payment has been made. You will not, however, own preliminary drafts, unused concepts, or other material produced during the revision process, these remain our property. You grant us a right to reference completed projects, briefs, and Final Products for our own archival and promotional purposes. We make no representation regarding the availability of trademark or copyright protection for any Final Product, and we recommend you conduct your own due diligence if you intend to register or protect it. We are under no obligation to assist with trademark, copyright, or similar filings on your behalf.
6.5 File Release Fee
A one-time administrative fee of $10 applies to the release of final project files upon order closure.
7Confidentiality and Privacy
We take reasonable steps to follow our Privacy Policy, which may be updated from time to time at our discretion. We are not responsible for the misuse of information submitted to the Site by any party, including through unauthorized access such as hacking.
8Disclaimers, Liability, and Indemnity
8.1 Content Responsibility
We do not guarantee the accuracy, completeness, or reliability of content submitted through the Service by any party, and we do not endorse opinions expressed by users. Any reliance you place on information available through the Service is at your own risk, and you are responsible for confirming that your use of any Response does not infringe third-party rights.
8.2 Third-Party Links
The Site may link to third-party websites or services. We do not control and are not responsible for that content, and including such a link is not an endorsement. You access third-party content at your own risk.
8.3 Warranty Disclaimer
The Service and all Responses are provided on an “as is” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties regarding uninterrupted or error-free operation of the Site. We do not warrant that the Service will meet your specific needs.
8.4 Disputes Between Users
The Service functions as a platform connecting Clients and Team Members. We make reasonable efforts to verify user identity but cannot guarantee that any user is who they represent themselves to be. If a dispute arises between users, you release Jackson Hill Digital, its affiliates, and employees from claims and damages arising from that dispute, to the extent permitted by law.
8.5 Indemnification
You agree to defend, indemnify, and hold harmless Jackson Hill Digital and its affiliates, officers, and employees from claims, damages, and reasonable legal costs arising from your breach of these Terms or misuse of the Service.
8.6 Limitation of Liability
To the fullest extent permitted by law, neither Jackson Hill Digital nor any third party involved in providing the Service will be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or business interruption, arising from your use of the Site or these Terms, even if advised of the possibility of such damages. Our total liability to you under these Terms will not exceed the total amount you paid for the package giving rise to the claim. These Terms are governed by the laws of the United States.
